ErudAite, Inc. (“we”, “our”, or “us”) collects, uses, and discloses personal information (the “Personal Information”) in the course of providing our ultra-high-precision translation services (the “Service(s)”). We have established this Privacy Policy (this “Policy”) to explain how we process the Personal Information and to protect the privacy of data subjects residing outside Japan in accordance with the laws and regulations applicable to such processing of the Personal Information (the “Applicable Laws”, including the General Data Protection Regulation (EU) 2018/679 (“GDPR”) where applicable).

For the processing of Personal Information of data subjects residing in Japan, a separate policy “ErudAite Privacy Policy” shall be applied and be referred to.

1. Processing of Personal Information

(1) Acquisition of Personal Information

We acquire Personal Information lawfully, fairly and transparently, and at the same time, devote our utmost attention to ensuring that the Personal Information is used only for those purposes that are clearly specified in advance. The processing of Personal Information will be conducted only to the extent necessary to achieve those purposes set forth in “(2) Purposes of Processing” below, based on your consent where we have obtained it, where necessary for the performance of a contract with you, or where necessary for our legitimate business interests.

The Personal Information we collect from you includes, but is not limited to, the following information:

Your name, user ID, email address, account login credentials, billing information (such as credit or debit card number and billing address), usage data (such as IP address, browser type, OS, and access logs), essential cookies required for the provision of the Service, and any text data you input into our translation service (which may contain Personal Information about yourself or third parties).

Some of the Personal Information is necessary for us to enter into a contract with you or to provide our Services to you. In case you do not provide us certain information when requested, we may not be able to provide our full support with respect to our Services. We collect your Personal Information directly from you when you use our services. We do not collect Personal Information from publicly available sources or third parties unless explicitly stated. However, if you input Personal Information regarding third parties into our translation service, you are responsible for ensuring you have the legal right to share such information with us.

(2) Purposes of Processing

The Personal Information provided to us will be used within the scope of our legitimate business purposes and only to the extent necessary to achieve those purposes set forth below.

  • To provide our web browser-based machine translation service, including services made available through a web interface or browser extension to you;
  • To manage and administer your personal accounts, subscriptions, and registrations to the Services;
  • To handle and complete payment transactions for paid services through a third-party payment processor;
  • To appropriately address and manage inquiries received from you;
  • To maintain, operate, and troubleshoot the Services, including preventing or addressing security and technical issues;
  • To transmit the text data you input (which may contain Personal Information) to third-party external services (including external Large Language Models (LLMs) or translation engines) outside of our company, solely for the purpose of executing the translation, improving service quality, and fixing technical issues;
  • To conduct statistical analysis based on non-personally identifiable usage data for the purpose of enhancing and upgrading the Services;
  • To retain or obtain the Personal Information when necessary to comply with our legal obligations;
  • To respond to requests from governmental authorities or investigative agencies.

(3) Provision and Cross-border Transfer of Personal Information

We will disclose the Personal Information listed in “(1) Acquisition of Personal Information” above to our business partners, payment service providers, and third-party external service vendors (such as cloud and LLM providers who receive your input text data to execute translations), so long as such disclosure is conducted within those purposes and means set forth in “(2) Purposes of Processing” above. Please be expressly aware that the text data you input into our service is not processed solely within our company, but is transmitted to and processed by these third-party external vendors. As a result of the disclosure, the Personal Information may be transferred to locations outside the country where you are located. The Personal Information protection laws in such locations where Personal Information may be transferred may not have the same standard of protection as that of your location. In such cases, we will thoroughly examine the eligibility of the party to which the Personal Information is provided or entrusted and confirm that appropriate security measures are taken in the processing of Personal Information from the perspective of security of Personal Information.

(4) Procedures for Disclosure or Correction, etc., of Personal Information

If you wish to request disclosure, correction, addition, deletion, restriction of processing, suspension of use, suspension of provision to a third party, or data portability, etc., of the Personal Information, (or make an objection), as permitted under the Applicable Laws, please contact us by using the contact channels set forth in “4. To Contact Us” below. We will usually respond to such request regarding Personal Information within a reasonable period of time, once we can confirm that the request is made by the data subjects of the Personal Information and the data subjects are eligible to exercise the right under the Applicable Laws.

Where we process your Personal Information on the basis of our legitimate interests or for the performance of a task carried out in the public interest, you have the right to object to such processing at any time on grounds relating to your particular situation. Upon receipt of your objection, we will cease processing your Personal Information unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or for the establishment, exercise or defense of legal claims.

Where your Personal Information is processed for direct marketing purposes, you have the right to object at any time to such processing, and we will cease such processing immediately upon receipt of your objection.

You may also request to withdraw your consent for us to collect, use or disclose your Personal Information for any purposes, without affecting the lawfulness of such processing based on your consent before withdrawal thereof, by contacting us by using the contact channels set forth in “4. To Contact Us” below. In some cases, withdrawing consent may hinder our ability to facilitate, process, administer, provide, or maintain the Services to the requester.

You may exercise your rights before and after we disclose Personal Information to third parties in accordance with “(3) Provision and Cross-border Transfer of Personal Information” above if this is allowed under the Applicable Laws.

(5) Filing a Complaint

You may have the right to complain to your local data protection authority, or to a court of law under the Applicable Laws, if your data protection rights are violated. You may be entitled to claim compensation for damage or distress incurred or suffered in consequence of any unlawful processing of your Personal Information.

(6) Cookies

Cookies are small text files that websites send to your computer or other Internet-connected device to uniquely identify your browser or to store information or settings in your browser. We only use strictly necessary cookies that are essential for the operation of our web browser-based services (including payment processing for paid services). We do not use tracking or advertising cookies. Your browser may tell you how to be notified when you receive certain types of cookies and how to restrict or disable certain cookies. Please note, however, that without cookies you may not be able to use all of the features of our website.

(7) Automated Decision-Making

We do not use your Personal Information for automated decision-making, including profiling, that produces legal effects concerning you or similarly significantly affects you.

(8) Processing of Personal Information of Children

Our services are available to individuals under the age of 18. However, under the GDPR (or any other applicable law), if a user is under the age of 16 (or a lower age between 13 and 15 as determined by the applicable laws of the EU Member State where the user resides, or an age regulated under any other applicable law), the processing of their Personal Information based on consent shall be lawful only if and to the extent that consent is given or authorized by the holder of parental responsibility over the child.

We make reasonable efforts to verify in such cases that consent is given or authorized by the holder of parental responsibility, taking into account available technology. If we learn that we have collected Personal Information from a child below the relevant age threshold without the necessary parental consent, we will take steps to delete that information as soon as possible. Parents or guardians who become aware that their child has provided Personal Information to us without their consent may request deletion by contacting us as set forth in “4. To Contact Us”.

2. Security Measures and Retention Period

(1) Security Measures

We have established a management system and implemented appropriate security measures to protect Personal Information from unauthorized access, loss, destruction, falsification, leakage, etc., and to ensure the accuracy and safety of Personal Information. In addition to restricting the entry of unauthorized persons into the office where we process Personal Information, and conducting educational activities for all directors, employees, and other staff involved in the protection of Personal Information, we will appoint a person responsible for the management of Personal Information and strive to manage Personal Information appropriately. (2) Retention Period

We will retain your Personal Information only for the period necessary to accomplish those purposes for which it was collected. Specifically, consistent with our Terms of Service, we only store the text data you input into our service for translation purposes to the extent the translation process requires unless you use the dictionary function or any other functions which require data storage. In determining the proper retention period for other account and billing information and aforementioned functions, we take into account factors such as the volume, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure, the objectives for which the Personal Information is processed and whether those objectives can be met by other means, as well as applicable legal obligations.

3. Changes to this Policy

As part of our efforts to ensure that we properly manage, protect, and process Personal Information, we will be reviewing this Policy, and the procedures and processes in using Personal Information, from time to time.

We reserve the right to amend and update the terms of this Policy at our absolute discretion. You are encouraged to visit this Policy from time to time to ensure that you are well informed of our latest policies, etc. in relation to the protection of the Personal Information.
